Ontario Court of Appeal Releases Moore v. Getahun Decision

On January 29, 2015, the Ontario Court of Appeal released its highly-anticipated decision on the appeal in Moore v. Getahun, (2015 ONCA 55). The Canadian Institute of Chartered Business Valuators (“CICBV”), along with five other intervenors, including The Advocates’ Society, intervened on the appeal.

Vineland Power Inc. (Vineland) was successful at a recent appeal before the Ontario Environmental Review Tribunal of Vineland’s amended Renewable Energy Approval. The decision in Fairfield v. Director, which was issued on December 23, 2014, involved an amendment to approval conditions for a five wind turbine renewable energy project in West Lincoln.

This $135 million build-finance P3 project includes 146,000 square feet of new facilities and 60,000 square feet of redeveloped facilities.

On September 8, 2014, an affiliate of Concord Pacific Developments completed the post-construction purchase of the 10MW AC ‘Mighty Solar’ solar generation electricity project from an affiliate of Canadian Solar Inc. (NASDAQ-CISQ) for a purchase price of over $60 million. This follows Concord’s July 2014 purchase of the 10MW AC ‘Val Caron’ solar facility from Canadian Solar for approximately $60 million.
